These Terms of Service & Equipment Rental Agreement ("Agreement") govern all services provided by Ocean Signs BC ("OSBC"). By placing an order through our website, by email, by telephone, or by any other method, the Customer acknowledges that they have read, understood, and agree to these Terms. Acceptance of these Terms is confirmed by selecting the required agreement checkbox during the booking process.
For the purposes of this Agreement:
Customer means the real estate agent, brokerage, property manager, builder, or other individual or organization requesting services from Ocean Signs BC.
Equipment means all property supplied by Ocean Signs BC including, but not limited to, PVC signposts, metal anchors, brochure boxes, riders, hooks, clips, fasteners, hardware, replacement parts, and accessories.
Services include signpost installation, removal, rental, sign panel storage, sign printing, service calls, and any related products or services provided by Ocean Signs BC.
Ocean Signs BC provides professional real estate sign services throughout Central Vancouver Island, including:
Our goal is to provide dependable, professional, and timely service while complying with applicable municipal bylaws and industry best practices.
Ocean Signs BC provides service throughout the Regional District of Nanaimo and Oceanside, including but not limited to:
Additional service areas may be available and may be subject to additional travel charges.
Ocean Signs BC strives to complete all standard installation and removal requests within 48 business hours, excluding weekends, statutory holidays, extreme weather events, and circumstances beyond our reasonable control.
Completion times are targets only and are not guaranteed.
The Customer is responsible for ensuring all order information is complete and accurate, including:
Incomplete or inaccurate information may delay service and result in additional charges.
The Customer is responsible for confirming, prior to placing an order, that sign installation is permitted at the property. This includes obtaining any required approval from homeowners, strata corporations, homeowner associations, builders, developers, municipalities, or other governing bodies.
If Ocean Signs BC attends a property and installation cannot be completed due to lack of authorization, incorrect information, or restricted access, applicable trip charges may apply.
Vacant land and construction sites must have clearly marked property corners or locator stakes prior to installation.
Orders may be changed before 3:00 PM on the business day preceding the scheduled service whenever reasonably possible.
Late cancellations or changes may result in trip charges if service has already been dispatched.
Ocean Signs BC places signposts in locations that maximize visibility while considering:
Unless specific written instructions are provided, final sign placement is at the sole discretion of the installer.
If installation is refused after the installer has arrived on site, a minimum $30 service charge will apply.
The Customer assumes full responsibility for identifying and marking all underground hazards before installation.
This includes, but is not limited to:
Ocean Signs BC is not responsible for damage to underground facilities that have not been properly identified or marked prior to installation.
Ocean Signs BC offers secure indoor storage for sign panels.
Panels are stored in a secure facility and are insured while in storage.
Insurance does not apply while panels are installed at a property.
Customers are responsible for ensuring an adequate inventory of sign panels is available in storage to meet requested installation timelines.
All installations are provided on a rental basis.
All Equipment supplied by Ocean Signs BC remains the exclusive property of Ocean Signs BC at all times.
The standard rental period is one (1) year.
Ocean Signs BC reserves the right to charge a rental renewal fee of $30 after one year and every six (6) months thereafter until the Equipment is returned.
The Customer remains fully responsible for all Ocean Signs BC Equipment from the time it is installed until Ocean Signs BC has completed its removal.
This responsibility continues regardless of whether the Equipment is removed, relocated, damaged, stolen, discarded, or otherwise interfered with by:
The Customer remains responsible for all applicable replacement fees, service charges, and other costs until all Ocean Signs BC Equipment has been returned.
Customers shall not relocate, remove, reuse, loan, transfer, or otherwise interfere with Ocean Signs BC Equipment without prior written authorization.
All signposts, anchors, brochure boxes, riders, clips, hardware, replacement parts, and accessories supplied by Ocean Signs BC remain the exclusive property of Ocean Signs BC at all times.
Payment of any replacement fee, lost equipment charge, damage fee, or any other invoice does not transfer ownership of any Ocean Signs BC Equipment to the Customer or any third party.
Ocean Signs BC reserves the right to recover or retrieve its Equipment at any time.
The Customer authorizes Ocean Signs BC to enter the reasonably accessible front portion of a property for the purpose of installing, servicing, inspecting, removing, or recovering its rental Equipment.
The Customer warrants that they have the authority to authorize Ocean Signs BC to perform these services.
If Ocean Signs BC is unable to recover a signpost during a scheduled removal, or if Equipment cannot otherwise be located, the Customer will be invoiced a Lost Post Fee of $150.
Payment of the Lost Post Fee does not transfer ownership of the Equipment.
If the missing Equipment is later located or returned after the Lost Post Fee has been paid, Ocean Signs BC will refund the Lost Post Fee less a holding charge of $15 per month, calculated from the property's sale date until the Equipment is returned.
The holding charge compensates Ocean Signs BC for inventory shortages, administration, and lost rental opportunities.
If Ocean Signs BC Equipment is found installed at a property where Ocean Signs BC did not perform the installation, or where Equipment has been relocated, reused, or transferred without authorization, the Customer responsible for the listing may be charged:
Repeated unauthorized use may result in:
Ocean Signs BC reserves the sole discretion to determine whether unauthorized use has occurred.
Should any issue arise with an installation, including:
Customers should submit a service request through our website or by email.
Ocean Signs BC will respond as soon as reasonably possible.
Removal is included in the original installation price.
It remains the Customer's responsibility to request removal when the Equipment is no longer required.
Ocean Signs BC recommends scheduling removals approximately one week prior to property completion.
Pre-booked removals are welcomed and encouraged.
Invoices are issued monthly unless otherwise arranged.
Payment is due upon receipt.
Accounts unpaid after fifteen (15) days may be assessed a $5 late payment fee.
Balances remaining unpaid after thirty (30) days will accrue interest at 2.5% per month (30% annually) until paid in full.
Ocean Signs BC reserves the right to suspend service, remove installed Equipment, or refuse future service for accounts that remain unpaid for sixty (60) days or longer.
The Customer agrees to pay all reasonable costs incurred by Ocean Signs BC in collecting overdue accounts, including collection agency fees, legal fees, court costs, and any other costs permitted by law.
Ocean Signs BC will inspect all Equipment upon removal.
Damage may be documented by photographs and written records.
Charges may apply for Equipment that is:
Ocean Signs BC shall not be liable for delays, property damage, lost marketing opportunities, or consequential damages arising from:
Ocean Signs BC's maximum liability shall not exceed the amount paid by the Customer for the specific service giving rise to the claim.
Ocean Signs BC reserves the right to amend pricing, service areas, fees, and these Terms of Service at any time.
Current pricing in effect at the time an order is placed shall apply.
This Agreement shall be governed by and interpreted in accordance with the laws of the Province of British Columbia and the laws of Canada applicable therein.
These Terms of Service & Equipment Rental Agreement constitute the entire agreement between Ocean Signs BC and the Customer regarding the services provided.
No verbal statement, representation, or prior agreement shall modify these Terms unless confirmed in writing by Ocean Signs BC.
By placing an order with Ocean Signs BC, the Customer acknowledges that they have read, understood, and agree to these Terms of Service & Equipment Rental Agreement.
