Terms of Service

These Terms of Service ("Agreement") govern all services provided by Ocean Signs BC ("OSBC"). By placing an order through our website, by email, by telephone, or by any other method, the Customer acknowledges that they have read, understood, and agree to these Terms. Acceptance of these Terms is confirmed by selecting the required agreement checkbox during the booking process.

For the purposes of this Agreement:

Customer means the real estate agent, brokerage, property manager, builder, or other individual or organization requesting services from Ocean Signs BC.

OSBC Property means all signposts, metal anchors, brochure boxes, riders, hooks, clips, fasteners, hardware, replacement parts, and accessories owned by Ocean Signs BC and used by Ocean Signs BC in performing its Services. OSBC Property is not sold, leased, rented, or delivered to the Customer at any time.

Services means signpost installation and removal, sign panel storage, sign printing, service calls, and related work performed by Ocean Signs BC.

Ocean Signs BC is a full-service installation company. Ocean Signs BC supplies its own equipment, personnel, and vehicles; installs OSBC Property at a Customer-specified address; services it while it remains in place; and removes it when the listing concludes.

All installation, servicing, relocation, and removal work is performed exclusively by Ocean Signs BC personnel.

OSBC Property remains in the possession and control of Ocean Signs BC at all times. It is not delivered to the Customer, handed over to the Customer, or made available for the Customer’s own use. The Customer does not receive, hold, transport, install, relocate, or return OSBC Property at any time.

The Customer is engaging Ocean Signs BC to perform a service. Nothing in this Agreement grants the Customer any ownership, possessory, leasehold, or rental interest in OSBC Property, and no provision of this Agreement is to be interpreted as a lease, rental, hire, or bailment of goods.

Ocean Signs BC provides professional real estate sign services throughout Central Vancouver Island, including:

• Signpost installation and removal

• Sign panel storage

• Sign printing

• Placement of brochure boxes, riders, and accessories

• Service calls

Our goal is to provide dependable, professional, and timely service while complying with applicable municipal bylaws and industry best practices.

Ocean Signs BC provides service throughout the Regional District of Nanaimo and Oceanside, including but not limited to:

• Nanaimo

• Lantzville

• Nanoose Bay

• Parksville

• Qualicum Beach

• French Creek

• Coombs

• Errington

• Bowser

• Deep Bay

Additional service areas may be available and may be subject to additional travel charges.

Ocean Signs BC strives to complete all standard installation and removal requests within 48 business hours, excluding weekends, statutory holidays, extreme weather events, and circumstances beyond our reasonable control.

Completion times are targets only and are not guaranteed.

The Customer is responsible for ensuring all order information is complete and accurate, including:

• Civic address

• Street name

• Municipality

• Postal code

• Unit number (where applicable)

• Any required access instructions

Incomplete or inaccurate information may delay service and result in additional charges.

The Customer is responsible for confirming, prior to placing an order, that sign installation is permitted at the property. This includes obtaining any required approval from homeowners, strata corporations, homeowner associations, builders, developers, municipalities, or other governing bodies.

If Ocean Signs BC attends a property and installation cannot be completed due to lack of authorization, incorrect information, or restricted access, applicable trip charges may apply.

Vacant land and construction sites must have clearly marked property corners or locator stakes prior to installation.

Orders may be changed before 3:00 PM on the business day preceding the scheduled service whenever reasonably possible.

Late cancellations or changes may result in trip charges if service has already been dispatched.

Ocean Signs BC places signposts in locations that maximize visibility while considering:

• Public safety

• Municipal bylaws

• Property boundaries

• Underground utilities

• Installation feasibility

Unless specific written instructions are provided, final sign placement is determined by Ocean Signs BC at the sole discretion of the installer.

If installation is refused after the installer has arrived on site, a minimum $30 service charge will apply.

The Customer assumes full responsibility for identifying and marking all underground hazards before installation.

This includes, but is not limited to:

• Electrical services

• Natural gas lines

• Water lines

• Irrigation systems

• Invisible pet fences

• Cable television

• Telephone lines

• Landscape lighting

Ocean Signs BC is not responsible for damage to underground facilities that have not been properly identified or marked prior to installation.

Ocean Signs BC offers secure indoor storage for Customer-owned sign panels.

Panels are stored in a secure facility and are insured while in storage.

Insurance does not apply while panels are installed at a property.

Customers are responsible for ensuring an adequate inventory of sign panels is available in storage to meet requested installation timelines.

All signposts, anchors, brochure boxes, riders, clips, hardware, replacement parts, and accessories supplied by Ocean Signs BC remain the exclusive property of Ocean Signs BC at all times.

Payment of any replacement fee, lost property charge, damage fee, or any other invoice does not transfer ownership of any OSBC Property to the Customer or any third party.

Ocean Signs BC reserves the right to service, recover, or retrieve its property at any time.

The Customer does not take custody of OSBC Property. However, because OSBC Property is installed at a property that the Customer has arranged for Ocean Signs BC to attend, the Customer is responsible for the costs set out in this Agreement where OSBC Property is removed, relocated, damaged, stolen, discarded, or otherwise interfered with while installed, whether by:

• Homeowners

• Sellers

• Buyers

• Tenants

• Contractors

• Landscapers

• Municipal crews

• Neighbours

• Any other third party

This responsibility continues until Ocean Signs BC has completed removal or has otherwise recovered its property.

Neither the Customer nor any third party may relocate, remove, reuse, loan, transfer, or otherwise interfere with OSBC Property. The Customer will advise the seller and any other party at the property accordingly.

The Customer authorizes Ocean Signs BC to enter the reasonably accessible front portion of a property for the purpose of installing, servicing, inspecting, removing, or recovering OSBC Property.

The Customer warrants that they have the authority to authorize Ocean Signs BC to perform these services.

If Ocean Signs BC is unable to recover a signpost during a scheduled removal, or if OSBC Property cannot otherwise be located, the Customer will be invoiced a Lost Post Fee of $150.

Payment of the Lost Post Fee does not transfer ownership of the property.

If the missing property is later located or recovered after the Lost Post Fee has been paid, Ocean Signs BC will refund the Lost Post Fee less an administration and inventory charge of $15 per month, calculated from the property’s sale date until Ocean Signs BC recovers its property.

This charge reflects the administration involved and the cost of maintaining replacement inventory while the property is unavailable for service.

If OSBC Property is found installed at a property where Ocean Signs BC did not perform the installation, or where it has been relocated, reused, or transferred without authorization, the Customer responsible for the listing may be charged:

• Full installation fee

• Applicable trip charges

• Unauthorized Use Fee of $10 for the first occurrence

Repeated unauthorized use may result in:

• Increased unauthorized use fees

• Immediate removal of OSBC Property

• Suspension of account privileges

• Refusal of future service

Ocean Signs BC reserves the sole discretion to determine whether unauthorized use has occurred.

Should any issue arise with an installation, including:

• Leaning or fallen posts

• Missing brochure boxes

• Missing or incorrect riders

• Broken hardware

Customers should submit a service request through our website or by email.

Ocean Signs BC will respond as soon as reasonably possible.

Removal is included in the original installation price.

It remains the Customer’s responsibility to request removal when the installation is no longer required.

Ocean Signs BC recommends scheduling removals approximately one week prior to property completion.

Pre-booked removals are welcomed and encouraged.

Installations are priced on the basis of a listing period of up to twelve (12) months.

Where an installation remains in place beyond twelve months, an Extended Service Fee of $30 applies at twelve months and every six (6) months thereafter, until Ocean Signs BC completes removal. This fee covers continued servicing, site inspection, inventory administration, and account administration for that installation.

Invoices are issued monthly unless otherwise arranged.

Payment is due upon receipt.

Accounts unpaid after fifteen (15) days may be assessed a $5 late payment fee.

Balances remaining unpaid after thirty (30) days will accrue interest at 2.5% per month (30% annually)until paid in full.

Ocean Signs BC reserves the right to suspend service, remove installed OSBC Property, or refuse future service for accounts that remain unpaid for sixty (60) days or longer.

The Customer agrees to pay all reasonable costs incurred by Ocean Signs BC in collecting overdue accounts, including collection agency fees, legal fees, court costs, and any other costs permitted by law.

All prices are exclusive of applicable taxes. Any tax that applies to a service or product supplied by Ocean Signs BC will be shown separately on the invoice.

Ocean Signs BC purchases, owns, and uses its own equipment in performing its installation services. That equipment is not sold, leased, or rented to the Customer.

Ocean Signs BC will inspect all OSBC Property upon removal.

Damage may be documented by photographs and written records.

Charges may apply for property that is:

• Missing

• Broken

• Altered

• Modified

• Destroyed

• Excessively worn through misuse

Ocean Signs BC shall not be liable for delays, property damage, lost marketing opportunities, or consequential damages arising from:

• Municipal enforcement

• Severe weather

• Natural disasters

• Utility failures

• Road closures

• Labour disputes

• Vehicle breakdowns

• Government restrictions

• Third-party interference

• Incorrect information supplied by the Customer

• Circumstances beyond Ocean Signs BC’s reasonable control

Ocean Signs BC’s maximum liability shall not exceed the amount paid by the Customer for the specific service giving rise to the claim.

Ocean Signs BC reserves the right to amend pricing, service areas, fees, and these Terms of Service at any time.

Current pricing in effect at the time an order is placed shall apply.

• Lost / Missing Sign Post: $150

• Lost / Damaged Metal Anchor: $50

• Lost / Damaged Main Post: $80

• Lost / Damaged Upright Arm: $20

• Missing Brochure Box: $40 or $10 (depending on model)

• Additional Trip Charge: $30

• Incorrect Map Coordinates: $15

• Incorrect Address Information: $10

• Unauthorized Use (First Occurrence): $10, plus the full installation fee and applicable trip charges

• Vendor Cancellation at Property: $30 minimum

This Agreement shall be governed by and interpreted in accordance with the laws of the Province of British Columbia and the laws of Canada applicable therein.

These Terms of Service constitute the entire agreement between Ocean Signs BC and the Customer regarding the services provided.

No verbal statement, representation, or prior agreement shall modify these Terms unless confirmed in writing by Ocean Signs BC.

By placing an order with Ocean Signs BC, the Customer acknowledges that they have read, understood, and agree to these Terms of Service.
